Napa County prevailed in a lawsuit challenging the approval of a use permit for Bonny’s Vineyard after a Superior Court judge ruled that the case was time-barred and that the plaintiff did not state valid claims for relief.
Napa County Superior Court Judge Cynthia Smith adopted an Aug. 21 tentative ruling as the court’s final ruling following a hearing Friday, county officials said.
The case was filed by Water Audit California after the Napa County Board of Supervisors rejected the group’s appeal of the Planning Commission’s approval of the winery project, a press release issued Thursday noted.
Smith found that Water Audit California failed to serve the county within the required 90-day period after the board’s June 24, 2025, decision.
The Planning Commission approved Bonny’s Vineyard’s new winery use permit and related environmental documents Dec. 18, 2024. Water Audit California filed its lawsuit against the county in September 2025.
The case will be dismissed once the final order is entered.
